ACCEPTABLE TERMS OF USE


CheapDialup is an internet based service. CheapDialup is an ISP that provides dialup internet service. CheapDialup reserves the right to refuse service to anyone at any given time for reason(s) of infringement of copyrights or any other reason(s) at it's sole discretion.


SERVICE USAGE POLICY

CheapDialup does not allow the following. This applies to both free and paid hosting.

Spam (unsolicited bulk e-mail) & Undesirable E-mail Services - No spamming is allowed. We reserve the right to cancel anyone spamming immediately and without refund. We also reserve the right to cancel without refund, anyone who causes our company to be blocked by any e-mail service - this includes selling bulk-emailing software and/or e-mailing lists. Spammers will incur a minimum $50 service fee for each email deemed as Spam by definition up to a maximum of $500 per day.

CheapDialup will consider any email as Spam based on the complaints received from known Spam complaint sites.  These complaints will be weighed based on sheer numbers of complaints received from these two organizations.  We will take these complaints and the email in question to determine if this is a Spam email sent through our service. 

Customers using our service agree to the above mentioned fee if it is determined they have sent Spam through our network.  Customers also agree to allow us to charge their credit card on file for any such fees imposed by our network.  Customers also agree to not issue a chargeback for the charges made to their credit card.  If such a chargeback is issued, customer agrees to an additional $50.00 fee and agrees that if such a chargeback is made, to release the chargeback immediately and gives their credit card company permission to release the chargeback in our favor.

If you are found to be engaging in any of the above activities then your account will be terminated without warning and you will not be entitled to any refunds that you would otherwise have been entitled to on leaving/canceling your account with us.

Unlimited - The dialup service supplied by CheapDialup is unlimited but not dedicated.  Users are able to dialup as many times as they wish without limitations, but may not use the connection as a dedicated internet connection.  We consider anything over 350 hours a month as a dedicated connection and we will be glad to provide such service if desired.

PAYMENT POLICIES

All accounts are set up on a prepay basis. Although CheapDialup reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary date, whether that be monthly, quarterly or annually following the date the account was established. Customers will be automatically renewed each anniversary date of their account.

In situations where the account holder does not renew his/her account CheapDialup will immediately suspend the service until the outstanding charge is processed successfully. In addition, CheapDialup reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email after the online purchase has been made. At this point the customer's card will be charged automatically.


CANCELLATION AND REFUNDS

CheapDialup reserves the right to cancel services at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes CheapDialup service usage policy and or our terms of agreement a refund will only be issued at our discretion.

Customers may cancel their account at any time. Any incentives or "promotional gifts" offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Fees charged on a prepay basis are only refundable where the money back guarantee applies.

CheapDialup will not be responsible for any damages your business may suffer. CheapDialup makes no warranties of any kind, expressed or implied for services we provide. CheapDialup disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, server malfunctions, missed backups, non-deliveries, wrong delivery, and any and all service interruptions caused by CheapDialup`s proprietors and their employees. CheapDialup reserves the right to revise its policies at any time.

CheapDialup refers to the proprietors of ProvideNet Communications Corporation.

WE refers to the proprietors, employees and agents of ProvideNet Communications Corporation.

YOU refers to the party with whom CheapDialup has entered into agreements/contracts with and including his/her agents
